“Lu Xuanyu 67677/67678″ and other 8 fishing boats engaged in light fishing operations disassembled the terminal monitoring equipment without authorization — technology enables accurate investigation and punishment of behaviors evading supervision
(1) Basic facts
On February 14, 2022, Weihai Marine Development Bureau of Shandong Province found that eight fishing boats, including “Lu Yu67677/67678″ and “Lu Yu67509/67510″, had the same Beidou track height within 24 hours through a comparison of radar monitoring system in offshore waters. Suspected of disassembling the fishing boat Beidou terminal and installing it on the same fishing boat with metal halide fishing lights. Weihai Ocean Development Bureau jointly conducted an operation to inspect the fishing boat “Lu Yu 67509/67510″ and found that the two boats were respectively carrying the Beidou terminal equipment of eight fishing boats including “Lu Yu 676777/67678″. The fishery administration and law enforcement agency immediately recalled the fishing vessel with the above night lights, boarded the vessel for inspection, and finally confirmed the illegal fact that the vessel dismantled the terminal monitoring equipment without authorization.
(2) Processing results
According to Article 5 of Shandong Regulations on Regulating Marine Fishery Vessels, Weihai Marine Development Bureau of Shandong Province imposed a fine of 200,000 yuan, suspension of navigation for three months and suspension of the captain’s certificate for three months on the eight fishing boats equipped with 200 PCS 1000w squid green fishing lamps for dismantling their position monitoring equipment without authorization.
(3) Typical significance
This case is a major fishery illegal case of the Beidou terminal privately-dismantled fishing boat seized by the fishery administration law enforcement agency of Weihai City, Shandong Province, with innovative law enforcement concepts and advanced prevention and control methods. AIS, Beidou terminal and other equipment can monitor and record the ship’s track in real time, which plays an important role in navigation, collision prevention and safety accident investigation. It also helps the competent fishery authorities to accurately grasp the movements of fishing vessels, prevent illegal sailing and cross-border operations of fishing vessels, and can be used as evidence for administrative punishment. “Maritime Traffic Safety Law of the People’s Republic of China” explicitly forbade unauthorized disassembly of it, and provided for severe penalties. In practice, some fishing vessels, in order to evade supervision and engage in illegal fishing, disassemble the above vessel position monitoring equipment and install it on other vessels or place it in the harbor or on shore, thus giving the illusion that the vessel is operating legally or in a berthing state. In this case, the fishery administration law enforcement agency made full use of technology to enable it to monitor and compare the flight paths of several fishing vessels through technical means, promptly recalled abnormal fishing vessels for investigation and treatment, and severely punished illegal acts according to law, effectively avoiding the occurrence of illegal events such as risky sailing and illegal fishing, and effectively playing the role of warning and education of administrative law enforcement.
